Komatsu denied that a labral tear in the shoulder joint was related to cumulative job activites as a welder.
The welder underwent surgery and was subsequently released to return back to regular duty. The judge ruled that the shoulder condition and surgery were causally related to his work and awarded medical expenses, off work pay and permanent disability monies. The Judge found our experts testimony more persuasive than the doctor hired by Komatsu. After the award was entered, Komatsu settled the case.
